Tax Controversy and Litigation

The only two certainties in life are “death and taxes”

Notwithstanding the best business and tax planning, the IRS might see it differently.  LSS has substantial experience in handling federal and state tax controversies, from audit to litigation, including controversies that may arise from unapproved claims for refund.  Audits are frequently handled in concert with your CPA.  We have resolved tax controversies involving virtually every type of federal and state tax, including personal income, corporate, partnership, international, employment, estate and gift, nonprofit, excise, penalties, and various state and local taxes such as business income, sales and use, and property.

LSS strives to resolve contested matters at the earliest possible stage.  If an audit is not resolved at the examination level, we have extensive experience in handling federal tax cases before the IRS Office of Appeals and state tax cases before the state administrative hearing division.

If cases cannot be resolved administratively, our attorneys try federal tax controversies in court.  We have handled cases in every federal tax forum: U.S. Tax Court, U.S. District Courts, U.S. Court of Federal Claims, and U.S. Bankruptcy Courts.   We have represented taxpayers from all walks of life, involving amounts ranging from thousands of dollars to billions of dollars.  Several of our cases have generated national publicity.

While we are fully capable of litigating a tax controversy, we hold litigation as a last option, and pride ourselves on our strong reputation of negotiating resolutions that are fair and manageable.
